MBHB Represents Roku in Ex Parte Reexaminations Rejecting Claims Asserted Against the Company’s Streaming Devices

CHICAGO – May 6, 2024 – Full-service intellectual property law firm MBHB recently represented Roku Inc. in ex parte reexaminations of two IOENGINE LLC patents (U.S. Patent Nos. 10,447,819 and 10,972,584) that IOENGINE alleged Roku’s streaming video players infringed in litigation in the U.S. District Court for the Western District of Texas.

On April 19, 2024, the Patent Office issued office actions rejecting claims 184-192 of the ’819 patent and claims 1-99 of the ’584 patent, which includes all of the asserted claims in the district court litigation. The Patent Office’s rejections adopted arguments made by Roku in its requests for reexamination filed in September 2023.

The Patent Office’s office actions were issued the same day the jury in the district court litigation found that Roku did not infringe any of the asserted claims.

MBHB partners James Lovsin, Matesuz Kulesza, and Margot Ryan represented Roku. Lovsin is Chair of the firm’s PTAB Trials Practice Group.
