The U.S. Supreme Court has taken a keen interest in all things patent, and it continues with its recent grant of certiorari in the dispute involving Medtronic and Boston Scientific over who has the burden to prove infringement (or lack thereof) when a licensee in good standing sues the licensor for non-infringement. While we wait for the Supreme Court’s decision, the Federal Circuit Court of Appeals, other Federal appellate and district courts, and foreign courts have recently decided a number of other disputes involving the licensing of technology.
