MBHB will present a mid-year review of the top stories impacting trademark and copyright law. Topics will include:

  • Recent trademark and copyright cases at the U.S. Supreme Court, including Romag, Georgia v. Public.Resource.org, and Booking.com.
  • Recent TTAB decisions of note, including discussions on how statements in patent filings can result in trademark functionality and descriptiveness findings, risks in filing intent-to-use trademark applications in the name of an individual, and showing intent to use a mark filed in the United States via the Madrid Protocol.
  • Recent federal court decisions of note, including whether section 18 counterclaims can be brought in federal court and waiver of new arguments not brought before the Board.
  • Recent USPTO examination updates, including a new rule requiring foreign applicants and registrants to use U.S.-licensed attorneys; new rules regarding mandatory electronic filing, owner email addresses, and specimen requirements; and COVID-19 deadline extensions.
