PTAB Invalidity Proceedings – Lessons Learned in the First Two Years (Live MBHB Webinar)

In the fall of 2012, the America Invents Act (AIA) introduced several new proceedings for challenging the validity of patents at the U.S. Patent and Trademark Office. These proceedings, which are held before the newly-formed Patent Trial and Appeal Board (PTAB), include inter partes review (IPR), post grant review (PGR), and the transitional program for covered business method patents (CBM).

Since their introduction, the popularity of these proceedings has exploded, with the PTAB now seeing over 150 petitions filed per month. These new PTAB proceedings are changing the landscape of patent litigation, and it is now imperative for patent holders and patent challengers alike to be up to speed on these proceedings as they move towards the possibility of litigation.

This webinar will look at the rise of PTAB invalidity proceedings since their introduction and the lessons we have learned along the way. Topics will include:

  • An overview of PTAB invalidity proceedings and how they are being used
  • A discussion of the lessons we have learned over the PTAB’s first two years relating to initiating a PTAB proceeding, defending against a PTAB petition, conducting discovery during a PTAB proceeding, and putting on a PTAB trial
  • A look at the future of PTAB invalidity proceedings and their role in the landscape of patent litigation
